General Information

Summary:
The purpose of this course is to familiarize students with the basic theories behind, and practical aspects of the various laws, rules, and regulations applicable to the acquisition of private property through the Declaration of Taking process.

Learning Outcomes:
At the conclusion of the course, participants should possess a legal framework for which the Declaration of Taking is based. They should also be able to interpret a plan, document Right-of-Way office, and prepare a Declaration of Taking Request Package. Participants will be familiar with:
- The role of right of way professionals in eminent domain
- Authority for the filing of a declaration of taking
- Pre-Condemnation Negotiation procedures
- Filing the declaration of taking
- Providing proper notice of the declaration of taking
- Posting and publishing methods
- Preliminary Objections
- Title Searches and Bring Down Title Searches
- Interpreting right-of-way plans
- Various RW forms including but not limited to:
o RW-446
o RW-475M
o RW-400DTR
o RW-918
o RW-432
o RW-432ML
o RW-437
- Central Office procedures for DT processing
- Expedited DT processing
- Right-of-Way Office entries
- Stipulation to Amend a Declaration of Taking
